Terms of Service — We Sell Bags

Welcome to We Sell Bags. By using our website and placing an order, you agree to the following Terms of Service. Please read them carefully.


1. Online Store Terms

By visiting our site or purchasing from us, you confirm that:

  • You are at least 18 years old or have permission from a legal guardian
  • You will not use our products for illegal or unauthorised purposes
  • You will comply with all applicable South African laws and regulations

2. Contract Formation

An order placed on our website constitutes an offer to purchase. Acceptance of that offer occurs once we confirm dispatch of the goods.

We reserve the right to cancel or refuse any order prior to dispatch in the event of stock shortages, pricing errors, or suspected fraudulent activity.


3. Products & Descriptions

We make every effort to display product colours, materials, and details as accurately as possible. However, variations may occur due to lighting, screen differences, or manufacturing batches.

All products are subject to availability. We reserve the right to update, modify, or discontinue products at any time.


4. Pricing & Payment

All prices are listed in South African Rand (ZAR) and include VAT where applicable.

  • Prices may change without prior notice.
  • Errors or inaccuracies may be corrected at any time.
  • Orders affected by pricing or stock errors may be cancelled before dispatch.

Payments are processed securely through authorised payment partners. We do not store or have access to your full card or banking details.


5. Orders, Dispatch & Delivery

Once an order is placed, you will receive an order confirmation email acknowledging receipt.

Dispatch and delivery estimates are provided at checkout but may vary due to courier delays, public holidays, weather conditions, or factors beyond our control.

Risk in the goods transfers to the customer once delivery has been completed to the selected delivery address, locker, branch, or collection point and courier notification has been issued.

We are not responsible for:

  • Incorrect delivery details provided by the customer
  • Delays caused by courier networks
  • Failure to collect within the courier's allocated timeframe

If a parcel is returned due to incorrect details or non-collection, additional shipping fees will apply.


6. Cooling-Off & Consumer Rights

Nothing in these Terms limits or excludes your rights under the Consumer Protection Act (CPA). Where applicable, statutory rights relating to defective goods, distance sales, or cooling-off periods will apply.

If an order is cancelled prior to dispatch, a refund may be issued less any non-recoverable transaction costs.


7. Returns, Exchanges & Store Credit

Key points include:

  • Returns accepted within 30 days of delivery
  • Items must be unused, unworn, and in original condition with all tags attached
  • Original packaging and dust bags must be included
  • No cash refunds except where legally required
  • Return courier costs are the responsibility of the customer unless legally required otherwise

8. Damaged or Defective Items

Issues must be reported within 48 hours of delivery with supporting photographic evidence.

If confirmed defective under the CPA, we will remedy the matter in accordance with legal requirements.


9. Accuracy of Billing & Account Information

You agree to provide accurate, complete, and up-to-date information. Incorrect details may result in delays or failed deliveries.


10. Optional Tools & Third-Party Services

We may use third-party services including payment gateways, courier platforms, and Shopify applications. These operate under their own terms and privacy policies.

We are not responsible for the content or practices of third-party services beyond what is required under applicable law.


11. Personal Information

Your submission of personal information through our website is governed by our Privacy Policy.


12. Prohibited Uses

You may not use this site to:

  • Engage in unlawful or fraudulent activity
  • Violate South African laws
  • Transmit malicious code
  • Infringe intellectual property rights

13. Limitation of Liability

We Sell Bags shall not be liable for indirect, incidental, or consequential damages arising from use of our website or products, except where such limitation is not permitted under South African law.

Nothing in these Terms excludes or limits liability where such exclusion would be unlawful under the Consumer Protection Act.


14. Indemnification

You agree to indemnify and hold harmless We Sell Bags, its owners, and partners from claims arising from your breach of these Terms or unlawful use of the website.

We reserve the right to update these Terms at any time. Continued use of the website constitutes acceptance of any updated Terms.
